Copyright & IP Takedown Policy

How to submit a copyright or IP infringement notice, how Dubai processes takedowns, and the counter-notice procedure for users who believe a takedown was incorrect.
1. Introduction
Dubai Marketplace FZ-LLC ("Dubai", "we", "us", "our") respects intellectual property rights and expects all users of the Service to do the same. We are committed to responding promptly to credible notices of copyright infringement and other intellectual property violations.
Our takedown process is modelled on the notice-and-takedown framework established in UAE Federal Decree-Law No. 38 of 2021 on Copyrights and Neighboring Rights ("UAE Copyright Law"), which governs copyright protection and the liability of online service providers in the UAE. Nothing in this policy should be construed as an admission that any particular content does or does not infringe any intellectual property right.
This policy applies to all user-generated content on the Service, including but not limited to listing photographs, property descriptions, agent profile content, written reviews, and any other materials submitted by users.
2. How to File a Copyright Takedown Notice
If you believe that content published on the Service infringes your copyright or other intellectual property rights, you may submit a takedown notice to us. To be valid and actionable, your notice must include all of the following elements (modelled on the substantive requirements of UAE Copyright Law and analogous to the requirements of the US DMCA Section 512(c)(3), which we apply as a matter of international best practice):

Identification of the rights holder: Your full legal name and the name of the organisation you represent, if any. If you are acting as an authorised agent on behalf of the rights holder, you must state this expressly and confirm your authority to act.

Contact information: Your email address, postal address, and telephone number so we can communicate with you about your notice.

Description of the copyrighted work: A clear and complete description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, a representative list is acceptable, but each work should be identified with sufficient particularity (for example, by title, URL of original publication, or other identifying information).

Location of the infringing material: The specific URL or URLs on the Dubai platform where the allegedly infringing content is located. General statements that material appears "somewhere on the platform" are not sufficient and may delay processing.

Good faith statement: A statement that you have a good faith belief that the use of the material in the manner described is not authorised by the copyright owner, its agent, or applicable law.

Accuracy and authority statement: A statement that the information in your notice is accurate and, under penalty of perjury under UAE law, that you are the owner of an exclusive right that is allegedly infringed, or are authorised to act on behalf of the owner.

Signature: Your physical or electronic signature (typing your full name in the signature field of an email constitutes an electronic signature for these purposes).
Incomplete notices may be returned to you with a request for additional information, which may delay processing.
3. How to Submit a Notice
You may submit your takedown notice through either of the following channels:
- Online form: Complete the copyright notice form at /dmca on the Dubai platform. This is the fastest method and ensures all required fields are captured.
- Email: Send your notice to ip@example.com with the subject line:
Copyright Takedown Notice — [brief description of the work].
Please do not submit notices through general support channels, as they may not be routed to the intellectual property team in time to meet our response SLAs.
4. Our Response to Takedown Notices
Upon receiving a complete and valid takedown notice, Dubai will:
- Acknowledge receipt within 5 business days;
- Investigate the claim by reviewing the content in question against the information provided in the notice;
- Take a decision within 14 business days of receiving a complete notice. Where we determine that the content appears to infringe the claimed rights, we will:
- Remove or disable access to the infringing material;
- Notify the user who posted the material that it has been taken down and the reason why, providing a copy of the notice (with your personal contact details redacted where appropriate);
- Log the takedown as a "strike" against the relevant account.
In complex cases where additional investigation is required, we may extend the 14-day decision window by a further 7 business days, in which case we will notify both parties of the extension.
5. Counter-Notice Procedure
If content you posted has been removed in response to a takedown notice and you believe the removal was mistaken — for example, because you are the copyright owner, have a valid licence, or your use is permitted under applicable law — you may submit a counter-notice.
A valid counter-notice must include:

Your identification: Your full legal name, email address, and postal address.

Description of the removed material: A description, or the URL, of the content that was removed and its location before removal.

Good faith statement: A statement, made under penalty of perjury under UAE law, that you have a good faith belief that the material was removed as a result of mistake or misidentification.

Consent to jurisdiction: A statement that you consent to the jurisdiction of the courts of the Emirate of Dubai, UAE, and that you will accept service of process from the person who submitted the original takedown notice.

Signature: Your physical or electronic signature.
Submit counter-notices by email to ip@example.com with the subject line: Counter-Notice — [your username or listing reference].
Upon receiving a valid counter-notice, we will:
- Forward a copy to the original notifying party within 5 business days;
- Restore the content after 14 business days unless we receive notice that the notifying party has filed a court action to restrain the alleged infringement.
We cannot provide legal advice on whether your use of the content is lawful. If you are uncertain about your rights, we recommend consulting a qualified intellectual property lawyer.
6. Repeat Infringer Policy
Dubai operates a repeat infringer policy pursuant to UAE Copyright Law. We track substantiated takedown notices (i.e., notices that led to content removal and were not subsequently reversed following a counter-notice) against user accounts.
- After two substantiated takedown notices against the same account, we will issue a formal warning to the account holder.
- After three substantiated takedown notices (or fewer, where the infringement is particularly serious or deliberate), we may permanently terminate the account and prohibit re-registration.
We exercise discretion in applying this policy and consider all relevant circumstances, including the nature and severity of the infringement, whether the user promptly cooperated with the takedown, and whether there are strong countervailing factors.
7. Trademark and Other IP Rights
Although this policy is titled "Copyright & IP Takedown Policy," we also accept notices alleging infringement of registered trademarks, design rights, and other intellectual property rights recognised under UAE law. Trademark notices should follow the same format as copyright notices described in Section 2, adapted to describe the trademark registration number and jurisdiction, the allegedly infringing material, and the basis for the claim.

8. Misrepresentation
If you knowingly and materially misrepresent that content infringes a copyright, or that a counter-notice was filed in error, you may be liable under applicable UAE law for damages, including legal costs, incurred by Dubai or the affected user as a result of our relying on the misrepresentation. We take misrepresentation seriously and may refer cases of apparent abuse to the appropriate authorities.
